Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Event Horizon Apps LLC ("Event Horizon Apps," "we," "us," or "our") and govern your use of our website at eventhorizonapps.com and the applications and games we offer (each an "App," and together with the website, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Your use of an App is also governed by our End User License Agreement (EULA), and your use of the Services is subject to our Privacy Policy. If there is a conflict between these Terms and the EULA regarding the license to use an App, the EULA controls for that App.

Who we are

Event Horizon Apps LLC is a software studio based in Iowa, United States. You can reach us at info@eventhorizonapps.com.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you are under the age of majority, you may use the Services only with the involvement of a parent or guardian. By using the Services, you represent that you meet these requirements and that you are not barred from using them under applicable law.

The Services and where they are available

Our apps are currently distributed through third-party app stores (currently the Apple App Store and Google Play). Some apps are available only in the United States, while our games may be offered globally. We may add, change, restrict, or discontinue any App or feature, or its availability in a given region, at any time. We may also begin distributing apps directly in the future, in which case additional terms may apply at the point of sale.

License to use the Services

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for their intended, lawful purpose. The detailed license terms for each App — including app-store-specific terms — are set out in the EULA.

Accounts and sign-in

We do not operate our own user accounts. Where an App offers sign-in, it uses Sign in with Apple, which is provided and managed by Apple under Apple's terms. You are responsible for maintaining the security of any app-store or device account you use to access the Services.

Purchases, subscriptions, and billing

Our apps use different models: some are free, some offer a one-time purchase, some offer auto-renewing subscriptions, and some are supported by advertising. All purchases, subscriptions, and in-app purchases are sold and processed by the app store you download the App from, under that store's terms — not directly by us. By way of example:

• Subscriptions automatically renew at the price and interval shown at purchase until you cancel. You can manage or cancel a subscription in your app store account settings, and cancellation takes effect at the end of the current billing period.
• One-time purchases unlock the stated features or content for the App on your app store account, subject to the store's rules (including any family-sharing or re-download rights it provides).
• Ad-supported apps may display advertising served by third parties, as described in our Privacy Policy.

Prices may change, and applicable taxes may apply. If we begin selling directly in the future, we will present the specific payment, billing, and cancellation terms at checkout.

Refunds

Because purchases are processed by the app stores, refunds are handled by the applicable app store under its own refund policy (for example, Apple's or Google's). Please direct refund requests to the store where you made the purchase. We do not separately process refunds for app store purchases.

Acceptable use

You agree not to:

• Use the Services in any unlawful way or for any unlawful purpose.
• Attempt to disrupt, overload, reverse engineer, decompile, or gain unauthorized access to the Services or related systems, except to the limited extent such restriction is prohibited by applicable law.
• Copy, modify, distribute, sell, resell, rent, or create derivative works from the Services except as expressly permitted.
• Remove, obscure, or alter any proprietary notices, or circumvent any access, security, or usage controls.
• Use the Services to infringe the rights of others or to transmit malware, spam, or harmful content.

Intellectual property

The Services, including their software, design, text, graphics, logos, and branding, are owned by Event Horizon Apps LLC or its licensors and are protected by intellectual-property and other laws. These Terms do not transfer any ownership rights to you. "Event Horizon Apps" and our logos are our marks and may not be used without our prior written permission.

Feedback

If you send us ideas, suggestions, or other feedback, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use it for any purpose without obligation or compensation to you.

Third-party services

The Services may rely on, integrate with, or link to third-party products and services (including the app stores, Apple's sign-in, and ad networks). We are not responsible for third-party content, products, or practices, and your use of them may be subject to their own terms and policies.

Disclaimer of warranties — use at your own risk

You use the Services entirely at your own risk. You are solely responsible for any decisions you make or actions you take based on the Services and for any results, data loss, or damage to your device that may occur from using them.

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, error-free, or secure, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Event Horizon Apps LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the Services, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid us (or the applicable app store for the App at issue) in the twelve months before the claim, or US $50. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Event Horizon Apps LLC and its members, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or your violation of these Terms or of applicable law.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including if you violate these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Governing law and disputes

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services that is not otherwise resolved will be brought exclusively in the state or federal courts located in Iowa, and you consent to the personal jurisdiction of those courts — except that we may seek injunctive relief in any appropriate jurisdiction. Before filing a claim, you agree to first contact us at info@eventhorizonapps.com so we can try to resolve it informally. Nothing in this section limits any non-waivable rights you have under the laws of your home jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
