End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between you ("you") and Event Horizon Apps LLC ("Event Horizon Apps," "we," "us," or "our") governing your use of our software applications and games, including any updates, content, and documentation (each, the "Licensed Application"). By downloading, installing, or using a Licensed Application, you agree to this EULA. If you do not agree, do not download, install, or use the Licensed Application.
This EULA is between you and Event Horizon Apps only, and not with Apple Inc., Google LLC, or any other app store or platform ("App Provider"). The App Provider is not responsible for the Licensed Application or its content. Your use is also subject to our Terms of Service and Privacy Policy, and to the usage rules of the applicable App Provider (such as the Apple Media Services Terms and Conditions or the Google Play Terms of Service) (the "Usage Rules"). In the event of a conflict between this EULA and the Usage Rules regarding the Licensed Application, the Usage Rules will govern to the extent of the conflict.
1. License grant and scope
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Licensed Application as follows:
- You may install and use the Licensed Application only on a device that you own or control, and as permitted by the Usage Rules.
- If you obtained the Licensed Application through the Apple App Store, you may use it on any Apple-branded products that you own or control, as permitted by the Usage Rules, including via Family Sharing where offered.
- Except as permitted by the Usage Rules or required by applicable law, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.
The Licensed Application is licensed, not sold, to you. We and our licensors retain all rights not expressly granted to you.
2. Restrictions
You agree not to, and not to permit others to:
- Copy (except as expressly permitted by this EULA and the Usage Rules), modify, translate, or create derivative works of the Licensed Application.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Licensed Application, except to the limited extent such a restriction is prohibited by applicable law.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Licensed Application, except as expressly permitted by the Usage Rules.
- Remove, alter, or obscure any proprietary notices, or circumvent any security, access, licensing, or usage controls.
- Use the Licensed Application in any unlawful manner or in violation of this EULA, the Usage Rules, or applicable law.
3. Maintenance and support
Event Horizon Apps is solely responsible for providing any maintenance and support services for the Licensed Application, as we may specify, or as required under applicable law. The App Provider has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. For support, contact us at hello@eventhorizonapps.com.
4. Privacy
Our handling of information is described in our Privacy Policy. In summary, our current apps store your data on your device, we do not operate accounts (any sign-in uses Sign in with Apple, managed by Apple), and we do not pull your app data into our servers. You must use the Licensed Application in compliance with applicable privacy and data-protection laws.
5. Purchases, subscriptions, and ads
A Licensed Application may be free, offer a one-time purchase, offer an auto-renewing subscription, or be supported by advertising. All purchases, subscriptions, and in-app purchases are processed by the App Provider under its terms, and the App Provider's billing, renewal, and refund policies apply. Subscriptions renew automatically until canceled in your app store account settings. Ad-supported apps may display advertising served by third parties as described in our Privacy Policy.
6. Intellectual property
The Licensed Application and all intellectual-property rights in it are and will remain the property of Event Horizon Apps and its licensors. In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Event Horizon Apps — not the App Provider — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by this EULA.
7. Product claims
Event Horizon Apps, not the App Provider, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with any feature that uses or supports an ad-related framework. This EULA does not limit our liability beyond what is permitted by applicable law.
8. No warranty — use at your own risk
You use the Licensed Application entirely at your own risk. You are solely responsible for any decisions you make or actions you take based on the Licensed Application and for any results, data loss, or damage to your device that may occur from using it.
To the maximum extent permitted by applicable law, the Licensed Application is provided "as is" and "as available," with all faults and without warranty of any kind. We disclaim all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify the App Provider, and where applicable the App Provider may refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, the App Provider will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty will be our sole responsibility.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Event Horizon Apps be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of or relating to your use of or inability to use the Licensed Application, even if advised of the possibility of such damages. Our total liability for all claims relating to the Licensed Application will not exceed the greater of the amount you paid for the Licensed Application or US $50. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
10. Legal compliance and export
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable U.S. and other export-control and sanctions laws in using the Licensed Application.
11. Term and termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must stop all use of the Licensed Application and delete all copies. Sections that by their nature should survive (including restrictions, intellectual property, disclaimers, limitation of liability, and the App Provider provisions) will survive termination.
12. Third-party beneficiary
You acknowledge and agree that the App Provider, and the App Provider's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, the App Provider will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
13. Third-party terms and Google Play
You must comply with any applicable third-party terms when using the Licensed Application. If you obtained the Licensed Application through Google Play, the Google Play Terms of Service and Google's Usage Rules apply, and references to "App Provider" above include Google LLC as applicable to that distribution. If we make the Licensed Application available through additional channels (including direct distribution from our website) in the future, the corresponding platform or point-of-sale terms will apply to that channel.
14. Governing law
Except to the extent expressly provided otherwise by an App Provider's required terms, this EULA is governed by the laws of the State of Iowa, United States, without regard to its conflict-of-laws rules, and consistent with the governing-law and dispute provisions of our Terms of Service. This choice of law does not restrict any consumer-protection rights you may have under the laws of your home jurisdiction.
